Fiftycalibre Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.
By placing an order with Fiftycalibre Limited you warrant that you are at least 18 years old (or have parents' permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed with Fiftycalibre Limited for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.
Products
Certain products may be available exclusively online through this website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. As many of our products are finishes by hand, the colour variance may differ from product to product.
We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of Fiftycalibre Limited. We reserve the right to discontinue any product at any time.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Delivery
Delivery will be made at the Delivery Address provided to Fiftycalibre Limited. Fiftycalibre Limited will use reasonable endeavours to deliver the Product by the Delivery Date, however this is not guaranteed.
The Customer accepts that the risk of any loss, damage or deterioration of or to the Product shall be borne by the Customer from the time the Product is delivered to the Customer.
If for any reason the Customer directly or indirectly refuses or seeks to delay delivery on the Delivery Date, delivery will be deemed to have still occurred on the Delivery Date (with risk in the Product passing from that date) and, without prejudice to its other remedies, the Customer shall be liable to pay on demand full payment of the Price (as if delivery had occurred on the Delivery Date). In the event Fiftycalibre Limited at its sole discretion agrees to retain the Product pending delivery at a future date, the Customer will be liable on demand for payment of the Price and all storage, insurance and other costs incurred by Fiftycalibre Limited.
Inspection of goods
Upon delivery, the Customer is expected to inspect for damage before signing the Proof of Delivery Form or PDA screen. By signing the goods as ‘Received in Good Condition' you are waiving the right to claim for damaged goods.
Customs duties
It is the sole responsibility of the Customer to pay any and all customs/import duties that may arise as a result of international sales. Once dispatched, Fiftycalibre Limited is not responsible for any payment of duties and taxes, which may be required for the Goods to be released to the Customer.
Storage Fees
Due to insurance and space limitations, no storage can be provided for more than 3 weeks from order completion and notification. Storage fees will be incurred at the rate of NZD $50 per week and invoiced prior to delivery of order.
If orders are not fully paid within 3 months after completion, Nightworks Studio reserves the right to retain products and consider the order cancelled without refund.
